1.2 By accessing, browsing or using the Website or any associated Products or Services, You acknowledge that You have read, understood and agree to be bound by these terms and conditions (“Terms”). If You do not agree with these Terms, You must immediately cease using the Website and any associated Purchase Services.

1.3 Star reserves the right to vary, amend or replace these Terms at its sole discretion by publishing the revised Terms on the Website. Any such amendment shall take effect immediately upon publication unless stated otherwise. Continued access to or use of the Website constitutes acceptance of the amended Terms.

2. Acceptance of the Terms

2.1 You accept these Terms by remaining on the Website.

2.2 If You register for, or otherwise use, the Purchase Services, You will be deemed to have expressly accepted these Terms.

3. Registration and Member Accounts

3.1 To access the Purchase Services, You may be required to register as a user of the Website (“Member”). As part of the registration process, You may be required to provide personal information including, but not limited to:
(a) email address;
(b) mailing address; and
(c) telephone number.

3.2 You warrant that all information provided to Star in connection with registration and ongoing use is accurate, current, and complete.

3.3 Upon completion of the registration process, You become a Member and are granted a limited, non-transferable, revocable licence to use the Website for the purpose of accessing the Purchase Services in accordance with these Terms.

3.4 You must not use the Purchase Services if:
(a) You are not of legal capacity to enter into binding contracts; or
(b) You are prohibited from receiving the Purchase Services under the laws of Australia or any other jurisdiction applicable to Your use.

4. Member Obligations

As a Member, You agree:
(a) to use the Purchase Services only for lawful purposes and in accordance with these Terms and applicable laws;
(b) to maintain the confidentiality of Your account details, including passwords, and acknowledge that You are responsible for all activities under Your account;
(c) to immediately notify Star of any unauthorised use of Your account or breach of security;
(d) not to permit any third party to use Your registration or account;
(e) not to use the Website or Purchase Services for any unauthorised, fraudulent, or unlawful purpose;
(f) not to engage in any conduct that could damage, disable, overburden or impair the Website; and
(g) not to engage in automated data collection activities, including scraping, data mining or similar.

5. Purchase of Products and Returns Policy

5.1 By placing an order via the Website, You agree to pay the purchase price displayed at checkout for the relevant Products (“Purchase Price”) together with any applicable freight and delivery charges.

5.2 While Star endeavours to ensure accuracy of all details, descriptions, and pricing, errors may occur. If an error in the Purchase Price is discovered after an order has been submitted, Star will notify You as soon as practicable, and You may elect either to reconfirm the order at the corrected price or cancel the order. Where cancellation occurs, any amounts paid will be refunded to the original method of payment.

5.3 Product availability is subject to change, and Star does not warrant the continuous availability of any Products listed on the Website.

5.4 Prices may be varied at Star’s discretion and will take effect upon publication on the Website.

5.5 Payment is due upon placement of the order and may be processed via Star’s nominated payment gateway provider (currently Eway). By using the Payment Gateway, You agree to comply with its terms of use and privacy policy.

5.6 Upon confirmation of payment, Star will issue a receipt and may retain transaction details for record purposes.

5.7 Change of Mind: To the maximum extent permitted by law, Star does not accept returns and does not offer refunds or exchanges for change of mind, incorrect selection, or price comparison.

5.8 Inspection on Delivery: You must inspect all goods upon delivery and notify Star in writing within five (5) business days of delivery of any defect, damage, shortage, or non-compliance. Failure to do so constitutes deemed acceptance of the goods.

5.9 Returns: Subject to the Australian Consumer Law and these Terms, returns will only be accepted where:
(a) You have complied with clause 5.8;
(b) Star has agreed in writing that the goods are defective;
(c) the goods are returned within a reasonable time in substantially the same condition as delivered; and
(d) the goods are packaged adequately to avoid damage in transit.

6. Warranty and Statutory Guarantees

6.1 All Products supplied by Star are subject to the consumer guarantees under the Competition and Consumer Act 2010 (Cth) (“Australian Consumer Law”).

6.2 In the event of a major failure, You are entitled to a replacement or refund. For failures not amounting to a major failure, You are entitled to have the Products repaired or replaced.

6.3 To make a warranty claim, You must notify Star in writing within ten (10) days of purchase, providing proof of purchase and details of the alleged defect.

6.4 To the extent permitted by law, all other warranties, express or implied, are excluded.

7. Intellectual Property

7.1 All intellectual property rights in the Website, the Purchase Services, and related content are owned or licensed by Star. Nothing in these Terms transfers to You any rights of ownership in such intellectual property.

7.2 You must not copy, modify, reproduce, republish, or otherwise exploit any content from the Website without Star’s prior written consent, except where such use is expressly permitted by law.

8. Privacy

8.1 Personal information collected in connection with the Website and Purchase Services will be handled in accordance with Star’s Privacy Policy (available on the Website).

9. Disclaimer and Limitation of Liability

9.1 Except as required under the Australian Consumer Law, all representations, warranties, guarantees or conditions not expressly contained in these Terms are excluded.

9.2 To the extent permitted by law, Star excludes all liability for any indirect, consequential or incidental loss, including loss of profit, goodwill, data or opportunity, however caused.

9.3 Star’s total aggregate liability for any claim arising under these Terms shall not exceed the amount paid by You for the relevant Products.

 

10. Termination

Star may terminate or suspend Your account or access to the Website at any time where You breach these Terms, engage in unlawful conduct, or where continued access is no longer commercially viable.

11. Dispute Resolution

11.1 Before commencing proceedings in respect of any dispute arising under these Terms, the parties must first attempt to resolve the dispute in good faith through negotiation and, if not resolved within 28 days, through mediation administered in Melbourne, Australia by the Australian Mediation Association.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Victoria, Australia. The parties submit to the exclusive jurisdiction of the courts of Victoria.

13. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
